Terms of Service

These Terms of Service ("Terms") govern your access to and use of 4truck, a fleet management platform operated by ABC LEGACY LLC ("4truck", "we", "us", or "our"). By creating an account, accessing the dashboard, or otherwise using the 4truck platform (the "Service"), you agree to be bound by these Terms.

If you are accepting these Terms on behalf of a company, you represent that you have authority to bind that company. In that case, "you" refers to that company.

1. The Service

4truck provides software-as-a-service tools for trucking and logistics companies, including:

• Fleet management and vehicle tracking dashboards
• Driver records and qualification file organization
• Document storage with optional Bring-Your-Own-Storage Google Drive integration
• Maintenance, fuel, and work-order tracking
• Reports, alerts, and scoring tools
• Integrations with third-party telematics providers (e.g., Samsara)

2. Eligibility and Accounts

• You must be at least 18 years old and authorized to bind the company you represent.
• You must provide accurate, current, and complete information during registration.
• You are responsible for safeguarding your login credentials. Notify us promptly at [email protected] of any suspected unauthorized access.
• You are responsible for all activity that occurs under your account.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service or related infrastructure
• Reverse engineer, decompile, or attempt to extract source code from the Service except as permitted by law
• Resell, sublicense, or commercially redistribute access to the Service without our written consent
• Upload malicious code, viruses, or content that infringes third-party rights
• Misrepresent your identity or impersonate another person or entity
• Use the Service to harass, threaten, or harm any individual

4. Your Content

You retain ownership of all data, documents, and content you upload or store through the Service ("Customer Content"). By using the Service, you grant 4truck a limited, non-exclusive, royalty-free license to process Customer Content solely as necessary to provide the Service to you.

You represent and warrant that you have all rights necessary to upload Customer Content and that Customer Content does not violate any law or third-party rights.

5. Google Drive Integration (Optional)

If you choose to connect your Google Drive account, you authorize 4truck to use Google's drive.file OAuth scope. This scope limits 4truck to files it creates within your Drive or that you explicitly select.

• Files stored via the Drive integration remain in your Google account — not on 4truck servers.
• You can disconnect Drive at any time from Settings → Disconnect Google Drive, or via Google account permissions.
• 4truck's use of Google API data adheres to the Google API Services User Data Policy, including Limited Use requirements. See our Privacy Policy for details.
• If you disconnect or delete files from your Drive, those files become unavailable through 4truck. You are responsible for retaining any required compliance records.

6. Third-Party Integrations

The Service may integrate with third-party platforms (e.g., Samsara, Google, Telegram). Your use of those third-party services is subject to their own terms and privacy policies. 4truck is not responsible for the practices or content of third-party services.

8. Fees and Payment

If your use of the Service is subject to fees, the applicable pricing and billing terms will be presented to you at signup or in a separate order form. Unless otherwise specified:

• Fees are billed in advance for the applicable subscription period.
• All fees are non-refundable except where required by law.
• You authorize us to charge your selected payment method for recurring fees.
• We may change pricing on 30 days' written notice; changes take effect at your next renewal.

9. Termination

• By you: You may cancel your account at any time by contacting [email protected].
• By us: We may suspend or terminate your access for material breach of these Terms, unpaid fees, or as required by law. We will provide reasonable notice except in cases of urgent security or legal risk.
• Effect of termination: Your access to the Service ends; account data is deleted within 30 days per our Privacy Policy. Files stored in your own Google Drive are not affected.

10. Service Availability and Modifications

We aim for high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at our discretion. Material changes affecting paid features will be communicated with reasonable notice.

11. Intellectual Property

The Service, including software, design, trademarks, and content (excluding Customer Content), is owned by ABC LEGACY LLC or its licensors and is protected by intellectual property laws. No rights are granted to you except as expressly set forth in these Terms.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OPERATION. 4truck DOES NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT IT WILL BE ERROR-FREE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ABC LEGACY LLC AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IN ANY 12-MONTH PERIOD SHALL NOT EXCEED THE FEES YOU PAID TO 4truck DURING THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR USD $100 IF NO FEES WERE PAID.

14. Indemnification

You agree to indemnify and hold harmless ABC LEGACY LLC, its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from (a) your use of the Service, (b) your Customer Content, (c) your violation of these Terms, or (d) your violation of any law or third-party right.

15. Governing Law and Disputes

These Terms are governed by the laws of the State in which ABC LEGACY LLC is registered, without regard to conflict-of-laws principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in that jurisdiction, and you consent to personal jurisdiction there.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email to account administrators and posted at this URL with an updated "Effective date" at the top. Continued use of the Service after changes take effect constitutes acceptance.

17. Miscellaneous

• Entire agreement: These Terms, together with the Privacy Policy and any order forms, constitute the entire agreement between you and 4truck.
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• No waiver: Our failure to enforce any provision is not a waiver of our right to enforce it later.
• Assignment: You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
